Policies, Procedures, Fee Agreement, Assumption of Risk, and Release of Liability


Thank you for choosing A1 Sports Coaching Group LLC ("A1"). Our goal is to provide a safe, professional, and positive learning environment for every swimmer. By registering for and participating in any A1 swim lesson or program, you agree to the following Terms and Conditions, which govern all private, semi-private, tri-private, clinics, camps, and other swim programs offered by A1.


1. Policies and Procedures


1.1 Lesson Schedule

Private, semi-private, and tri-private swim lessons are thirty (30) minutes in duration and are scheduled once per week on the same day and at the same time with the same coach whenever reasonably possible. Camp and clinic schedules may vary.


1.2 Tuition and Fees

A1 offers single swim lessons and multi-lesson packages. Tuition is due in full before the first scheduled lesson. Enrollment reserves a specific weekly lesson time rather than a flexible number of lessons. Tuition covers professional swim instruction and scheduled pool time only and does not include recreational swimming before or after lessons. Participants are responsible for attending all scheduled lessons. Changes to lesson times, coaches, or locations may only be made with written approval from the A1 administrative office.


1.3 Registration

By purchasing a 2-, 3-, 4-, or 8-lesson package, you agree to attend the scheduled lessons consecutively, once per week, at the assigned day, time, and location unless prior arrangements were agreed on in writing. Projected lesson dates will be provided by email and on the initial invoice.


1.4 Cancellation and Withdrawal

Cancellation requests must be submitted by email at least twenty-four (24) hours before the scheduled lesson. Telephone calls, text messages, verbal conversations, voicemail messages, or social media messages are not accepted as official cancellation requests. Cancellation and make-up privileges apply only to eligible Elite Programs.

If you withdraw before completing a lesson package:

  • Completed lessons will be recalculated at the applicable single-lesson rate or package pricing in effect at the time of purchase.

  • A $30 administrative processing fee will apply.

  • Any remaining eligible balance will be refunded.

If you reserve a lesson time and withdraw before the package begins, the reservation fee and package are non-refundable.


1.5 Refund Policy

Tuition reserves your weekly lesson time regardless of attendance. Missed or unused lessons are non-refundable and may not be credited except as specifically provided in these Terms. No refunds or credits will be issued due to illness, vacations, scheduling conflicts, or other personal reasons. No refunds or credits will be issued if A1 is unable to conduct lessons because of circumstances beyond its reasonable control, including but not limited to severe weather, facility closures, natural disasters, government orders, public health emergencies, or other force majeure events.


1.6 Facility Closures

If A1 cancels a lesson because of scheduled facility maintenance, weather, coach illness, or other operational reasons within A1's control, A1 may offer a make-up lesson based on coach and pool availability. If lessons cannot be conducted because of circumstances beyond A1's reasonable control, no refunds, credits, or make-up lessons are guaranteed.


2. Elite Program Make-Up Policy

The following policy applies only to eligible Elite private and semi-private lesson packages.


Make-Up Eligibility

  • One (1) make-up lesson is provided with each eligible 8-lesson package.

  • A minimum of twenty-four (24) hours' written notice by email is required.

  • Late cancellations are not eligible for a make-up lesson


Scheduling

  • Make-up lessons are subject to coach and facility availability.

  • A1 will offer two available make-up opportunities.

  • Clients must confirm the offered lesson within twenty-four (24) hours.

  • If the offered lessons are declined or no response is received, the make-up lesson is forfeited.

  • A1 will send two open slots to make up a missed lesson and if the client does not agree the lesson will be considered forfeited.


Cancelled Make-Ups

Once scheduled, a make-up lesson is considered final. If the client cancels or fails to attend the make-up lesson, it is considered used and will not be rescheduled.


Ineligible Programs

Flex Programs, tri-private lessons, group lessons, camps, clinics, and single private lessons are not eligible for make-up lessons unless specifically stated otherwise.


Semi-Private Lessons

All swimmers enrolled in the semi-private lesson must agree to the make-up schedule. Requests must be submitted by the individual who purchased the lesson package.


A1 Cancellations

If A1 cancels a lesson because of coach illness, weather, or facility closure, A1 will make reasonable efforts to provide a replacement lesson.


2.1 Lesson Renewals

Priority registration for Elite Programs is offered before the end of the current package. Lesson times are not guaranteed until the renewal invoice has been paid in full. A1 reserves the right to recommend different lesson times, coaches, locations, or programs based on participant progress, scheduling, or operational needs.Registration for new elite package has to be completed two weeks prior the end of the current one.


2.2 Payment

A1 accepts electronic payments only. Invoices must be paid before lessons begin. Lesson times are not reserved until payment has been received.


2.3 Coach Assignments

A1 strives to maintain the same coach throughout each lesson package. However, A1 reserves the right to substitute or reassign coaches whenever necessary because of scheduling, illness, staffing, participant needs, safety, or other operational reasons. A1 may discontinue coaching services if a participant's behavior is unsafe, disruptive, or prevents effective instruction.


2.4 Trial Lessons

A1 does not offer complimentary trial lessons.


2.5 Timeliness

Lessons begin and end at the scheduled time. Late arrivals do not extend lesson time.


2.6 Parent Responsibilities

A parent or legal guardian must remain at the facility during lessons for participants who are minors and must be immediately available if needed. Parents and guardians shall observe lessons from designated areas and may not coach, interrupt, or interfere with instruction during the lesson.


2.7 Swim Attire

Appropriate swimwear is required at all times. Children who are not fully toilet trained must comply with facility diaper requirements.


3. Assumption of Risk and Release of Liability

Swimming and aquatic activities involve inherent risks, including but not limited to slips, falls, collisions, physical injury, illness, drowning, permanent disability, and death. By participating, you voluntarily assume all inherent risks associated with participation in A1 programs. To the fullest extent permitted by applicable law, you release and hold harmless A1 Sports Coaching Group LLC, its owners, employees, contractors, coaches, volunteers, and representatives from claims arising out of participation in A1 programs, except to the extent liability cannot legally be waived. You certify that you or your child is physically able to participate and that any medical condition affecting participation has been disclosed to A1.


4. Emergency Medical Authorization

If the Parent or emergency contact cannot be reached and emergency medical treatment appears necessary, you authorize A1 to obtain emergency medical care for the Participant. You accept responsibility for all medical expenses arising from such treatment.


5. Electronic Communications

By enrolling in A1 programs, you consent to receive communications by email and text message regarding scheduling, invoices, weather closures, lesson reminders, registration, coach availability, and other administrative matters.


6. Acceptance of Terms

By registering for swim lessons, paying an invoice issued by A1 Sports Coaching Group LLC, checking an online agreement box, participating in any lesson, or otherwise accepting A1's services, you acknowledge that you have received, read, understood, and agree to be legally bound by these Terms and Conditions. Payment of an A1 invoice constitutes acceptance of this Agreement to the fullest extent permitted by applicable law. These Terms and Conditions supersede all prior oral or written agreements relating to the subject matter herein.

7. Media Release

A1 Sports Coaching Group LLC may photograph or video record participants during lessons and programs for instructional, educational, and promotional purposes in print, online, and social media. Please indicate your preference below.

Acknowledgment of Inherent Risks: The Participant and Parent acknowledge that swimming instruction, aquatic activities, physical exercise, competitive training, and participation in the Elite Swim Coaching Program involve inherent and unavoidable risks that cannot be completely eliminated, regardless of the level of supervision, instruction, coaching, or safety precautions. These risks include, but are not limited to: drowning; near drowning; slips, trips, and falls; collisions with other participants or pool equipment; impact with pool walls, lane lines, starting blocks, ladders, or decks; muscle strains; sprains; fractures; dislocations; cuts and abrasions; head injuries; spinal injuries; concussions; overexertion; dehydration; allergic reactions; exposure to chemicals; communicable illnesses; cardiac events; permanent disability; and death.


Assumption of Risk: The Participant and Parent knowingly, voluntarily, and expressly assume all risks, both known and unknown, inherent or otherwise, arising from or relating to participation in the Elite Swim Coaching Program, including risks arising during private coaching sessions, warm-up and cool-down activities, instructional demonstrations, dryland exercises, use of training equipment, entry into or exit from the pool, travel within the aquatic facility, and any activity reasonably related to participation in the Program.


Release of Liability: To the fullest extent permitted by Maryland law, the Participant and Parent, individually and on behalf of their heirs, executors, administrators, personal representatives, successors, and assigns, hereby release, waive, discharge, and covenant not to sue A1 Sports Coaching Group LLC, its owners, officers, members, managers, employees, independent contractors, instructors, coaches, volunteers, agents, representatives, affiliates, successors, and assigns from claims arising out of participation in the Elite Swim Coaching Program, including claims for personal injury, bodily injury, property damage, emotional distress, economic loss, and wrongful death, to the extent permitted by law.


Indemnification: To the fullest extent permitted by law, the Participant and Parent agree to defend, indemnify, and hold harmless the Released Parties from and against third-party claims, damages, liabilities, judgments, costs, and reasonable attorneys' fees arising from the Participant's violation of this Agreement, the Participant's negligent or wrongful conduct, damage caused by the Participant to property or equipment, injuries caused by the Participant to another person, or materially inaccurate information provided during enrollment.


Emergency Medical Authorization: If the Parent or emergency contact cannot be reached and immediate medical attention is reasonably believed necessary, the Participant and Parent authorize A1 to seek emergency medical care for the Participant, including emergency transportation, ambulance services, emergency room treatment, physician services, diagnostic testing, hospital admission, and other emergency treatment reasonably deemed necessary by licensed medical personnel. The Parent accepts full financial responsibility for all medical expenses incurred on behalf of the Participant.


Medical Expenses  A1 does not provide health, accident, disability, or medical insurance for Participants. The Participant and Parent are solely responsible for health insurance, medical expenses, rehabilitation expenses, prescription costs, transportation expenses, therapy, and any other expenses arising from illness or injury. The Participant is strongly encouraged to maintain adequate health insurance covering participation in athletic and aquatic activities.


Limitation of Liability: To the fullest extent permitted by law, A1's aggregate liability for claims arising out of this Agreement shall not exceed the amount of tuition actually paid by the Participant for the portion of the Program giving rise to the claim.
